Running a legally compliant agency on top of all of the 150 piece of current legislation and the vast changes to these that are scheduled for the next few years as the government move closer to regulation of the PRS, isn’t something that can be achieved cheaply. Please ensure you check your agent is fully trained and qualified with regular continuing professional development and refresher training, look for the ARLA|Propertymark experts. Do make sure your money is protected (two agents in this area have walked away with thousands of pounds of clients’ money in the last few years) with Client Money Protection and Professional Indemnity Insurance. Check that they meet their legal obligations, being clear and transparent about their services and fees, which should be displayed online. Read their terms and conditions carefully, ensure you know what you are agree to and seek clarification on anything you are unsure about.
Remember, there are fixed penalty notices of up to £30,000 for a range of housing offences, banning orders will shortly be in place for range of offences and some offenses can lead to prosecution. Using an agent doesn’t mean you are indemnified as a landlord so you have a responsibility to test your agents knowledge and ensure they are professionals who genuinely can care for what is your biggest investment asset!
